VICINITY CENTRES PRIVACY NOTICE

Vicinity Centres PM Pty Ltd (ACN 96 101 504 045) (‘We’, ‘Our’ or ‘Us’) on behalf of the Shopping Centre collects your personal information in order to run this Promotion, understand your interests and activities in relation to centres which we manage as well as plan, operate and manage these centres and the digital channels through which we engage with you. Where you consent to us doing so, we also use your personal information to contact you with centre news updates, events and promotions. We may disclose your personal information to our related bodies corporate and service providers, including those located in the USA and Singapore. We also de-identify and aggregate your data for market research and data analytics purposes. Voting Period

Start date: 01/08/24 at 08:00 am AWST

End date: 31/08/24 at 11:59 pm AWST

Category 1: more than 350 students

  • Hampton Park Primary School
  • Hillcrest Primary School
  • Inglewood Primary school
  • Morley Primary School

Category 2: less than 350 students

  • Camboon Primary School
  • Dianella Heights Primary School
  • Embleton Primary School

Eligible voters

Voting is only open to WA residents. Voters under the age of 18 must have parent or legal guardian approval to vote.

How to Vote

To vote, the voter must complete the following steps during the Promotional Period:

  • spend at least $50 in any number of transactions on any goods or services (other than the Excluded Items) at Galleria Shopping Centre in the course of one (1) day ("Qualifying Spend"); and
  • visit https://www.galleriashoppingce..., follow the prompts to the Promotion voting page; and fully complete and submit the online form with all requested personal details, select the Eligible School they would like to vote for, and answer the questions: "How did you hear about this competition?", "Which store did you shop at?", "How much did you spend?" and "When did you shop?".

Excluded Items:

The following products or services (including vouchers relating to such products or services) will not be eligible to purchase in order to meet the Qualifying Spend required to submit a vote: gift cards, liquor or tobacco products, weapons of any kind, prescription medicines and cosmetic or surgical procedures.

Winner Determination

The Eligible School with the highest number of votes in its respective category will be declared the winner and will receive either Prize 1 or Prize 2, depending on the number of students (see above). The school with the second highest overall number of votes (from both categories combined) will receive the Overall Runner-Up Prize.

Tie-Break Mechanic: if two (2) Eligible Schools are tied with the highest number of votes (for any prize), the prize money will be divided equally among those schools.

Votes permitted

There is a limit of one (1) vote permitted per person per Qualifying Spend.

Prize Conditions

The prize money will be deposited into the account of the winning schools (the Promoter will contact the winning schools to collect these details). The grant money must be used to support the winning schools’ programs and initiatives. It cannot be used for any other purpose unless agreed in writing by the Promoter.

Winner notification

The winning schools will be contacted by email or phone within seven (7) business days of the winners being determined. The winning schools will be published at https://www.galleriashoppingce... within 7 days of the winners being determined.

Unclaimed Prizes

In the event of an unclaimed prize, the Promoter may at its discretion assign the prize to the school with the next highest number of votes or withdraw the prize unawarded. The Promoter is under no obligation to award any unclaimed prize.

Further Conditions

  1. The voter agrees and acknowledges that they have read these Terms and Conditions (and Schedule) and that voting is deemed to be acceptance of these Terms and Conditions (and Schedule). Any capitalised terms used in these Terms and Conditions have the meaning given in the Schedule, unless stated otherwise.
  2. The Promotion commences on the Start Date and ends on the End Date ("Voting Period"). Votes are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the voter. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
  3. Valid and eligible votes will be accepted during the Voting Period.
  4. All reasonable attempts will be made to contact each winning school.
  5. If any winning school chooses not to take their prize (or is unable to), or does not take or claim a prize within a reasonable time, as specified by the Promoter, or is unavailable, they forfeit the prize and the Promoter is not obliged to substitute the prize.
  6. If there is a dispute regarding the winning school, the Promoter reserves the right, at its sole discretion, to determine the winning school
  7. It is a condition of accepting the prize that a winning school may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize.
  8. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  9. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected votes, or suspend or modify a prize.
  10. The Promoter reserves the right, at any time, to validate and check the authenticity of votes and voter's details (including a voter's identity, age and place of residence). In the event that a voter cannot provide suitable proof, their vote will be invalidated. Incomplete, indecipherable, inaudible, incorrect and illegible votes, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to vote. The use of any automated vote software or any other mechanical or electronic means that allows an individual to automatically vote repeatedly is prohibited and may render all votes submitted by that individual invalid.
  11. The Promoter reserves the right to disqualify votes in the event of non-compliance with these Terms and Conditions or where the Promoter has reason to believe that the voter has engaged in unlawful or other improper conduct calculated to jeopardize the fair and proper conduct of the Promotion. In the event that there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the complainant/voter/winning school. If the dispute cannot be resolved the Promoter’s decision will be final.
  12. The Promoter, the Shopping Centre owner/s and their associated agencies, related companies, officers, employees and contractors will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation). For the sake of clarity, this clause shall not apply where the Promoter has contributed to or caused such loss, expense, damage, personal injury or death and shall not apply to any liability which cannot be excluded by law (in each case the Promoter’s liability is limited to the minimum allowable by law).
  13. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
