In It Together Consumer ("Conditions of Entry")

Offer

1. The promoter is PPG Industries Australia Pty Ltd ABN 82 055 500 939, 14 McNaughton Road, Clayton, VIC 3168, Australia. Ph: 13 24 24 (“Promoter”).
2. From 1 April 2023, consumers who purchase 4L of Taubmans Endure, Taubmans All Weather, Taubmans Easycoat, Taubmans 3 in 1, Taubmans Ceiling or Taubmans Sunproof from a participating store in Australia will be supporting GIVIT charity, by indirectly contributing to donations to the GIVIT charity.
3. PPG has engaged Bunnings stores nationally to participate in the donation offer, whereby:
   1. If Bunnings Head office purchases from PPG (via PPG Customer Service or online ordering system) the Agreed Quantity* of Taubmans Endure, Taubmans All Weather, Taubmans Easycoat, Taubmans 3 in 1, Taubmans Ceiling and Taubmans Sunproof – all in 4L size, for every Bunnings store within Australia during the Buy-In Period (“Eligible Order”), PPG will donate:
      1. AUD$5 to GIVIT Listed Ltd ABN 21 137 408 201 - Goods for Good Causes (GIVIT) for each can of Taubmans Endure, Taubmans 3 in 1, Taubmans Ceiling and Taubmans All Weather purchased in the Eligible Order; and
      2. AUD$2.50 to GIVIT for each can of Taubmans Easycoat and Taubmans Sunproof purchased in the Eligible Order.
      3. *The Agreed Quantity is the specified quantity agreed in writing by both PPG and Bunnings.
4. The Buy-In Period starts 9am AEDT 20/03/23 and ends 11.59pm AEST 15/05/23 (“Buy-In Period”). The products purchased by participating stores (i.e. Bunnings stores within Australia) for this offer will only be available to on-sell to consumers from 01/04/23 to 13/05/23 (“Offer Period”).
5. In the case of any other participating store, the Promoter will keep a record of purchases made between 01/04/23 and 13/05/23 (via the participating store) and make a donation as follows:
   1. AUD$5 donated for each can of Taubmans Endure, Taubmans 3 in 1, Taubmans Ceiling and Taubmans All Weather sold at a participating store; and
   2. AUD$2.50 donated for each can of Taubmans Easycoat and Taubmans Sunproof sold at a participating store.
6. The Promoter will donate up to a maximum total amount of AUD$180,000 to GIVIT (across Bunnings and other participating stores).
7. The exact time of an order to be eligible for the donation offer will be determined by the Promoter in consultation with the individual participating stores.
8. Funds collected will be given to GIVIT and distributed as agreed in PPG’s Charitable Donation Pledge Agreement and MoU with GIVIT.
9. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
10. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion or not fulfil any donation to GIVIT.
11. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
12. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
