Vicinity Centres PM Pty Ltd (ACN 96 101 504 045) (‘We’, ‘Our’ or ‘Us’) on behalf of the Shopping Centre collects your personal information in order to run this Promotion, understand your interests and activities in relation to centres which we manage as well as plan, operate and manage these centres and the digital channels through which we engage with you. Where you consent to us doing so, we also use your personal information to contact you with centre news updates, events and promotions. We may disclose your personal information to our related bodies corporate and service providers, including those located in the USA and Singapore. We also de-identify and aggregate your data for market research and data analytics purposes. Eligible Participants
Participants under 18 must have a parent or legal guardian complete the entry form on their behalf and accompany them.
How to Participate
To enter the birthday activity zone, participants must complete the following steps during the Promotional Period:
- visit the Warwick Grove 50th
Birthday Celebrations located near Wizard Pharmacy at Warwick Grove between 11am and 2pm (“Event’);
- scan the QR code outside the Event and complete the online entry form for the Promotion with their personal details as requested; and
- show the completed entry form to staff.
By completing the form, participants subscribe to receive news of Warwick Grove events and promotions via email or SMS from Vicinity Centres.
The Event includes a ‘Back to School’ kids’ workshop, where children can personalise their own bags (provided at the Event). This Event also features historical images of the centre and a memory box, inviting participants to share their fondest memories of the centre.
Event Conditions
- Participants must comply with all reasonable directions of Event personnel, including their employees, contractors, authorised agents and security personnel. Health and safety is a priority for the Event, so in particular:
- While waiting to enter the Event area, participants must wait where indicated by Event personnel and relevant signage;
- All participants under the age of 18 must be accompanied by a parent or guardian;
- No food or drink (other than drink bottles for adults or children) will be permitted in the Event area;
- Smoking (including e-cigarettes) is not permitted in the Event area;
- Participants must allow the Promoter to inspect their bag and personal items to check compliance with these Event conditions;
- Participants must not use a laser pointer within the Event area
- Parents/caregivers must ensure that children are supervised, remain under their control at all time.
- Participants (and any children in their care) must not engage in anti-social, disruptive, threatening, abusive, unlawful, harassing or otherwise inappropriate behaviour. This includes (for example):
- Engaging in conduct that is not consistent with the instructions given by Event personnel which may result in damage to the Event;
- Engaging in conduct that may jeopardise the proper conduct of the Event or the health and safety of those present; or
- Doing anything that may diminish the good name or reputation of the Promoter.
In the event of any breach of these Event Conditions, the Promoter retains the right (in their absolute discretion) to refuse a participant (and children in their care and any group members) entry to the Event area or to require that they the Event area or Shopping Centre.
Further Conditions
- The participant agrees and acknowledges that they have read these Conditions of Entry (and Schedule) and that participating in an Event in the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise.
- The Promotion commences on the Start Date and ends on the End Date ("Promotional Period").
- Employees (and their immediate family members) of agencies/companies directly associated with the conduct of this Promotion, the Shopping Centre, the Promoter, their tenants, businesses involved in the management of the Promotion, any organisation benefiting from the Promotion, the Promoter’s distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to participate in an Event. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent.
- A nominated parent/guardian must accompany any person under 18 years of age.
- Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
- If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify an Event.
- The Promoter reserves the right, at any time, to validate and check the authenticity of participants and participant's details (including a participant's identity, age and place of residence). In the event that a participant cannot provide suitable proof as required by the Promoter to validate their entry, the participant will forfeit the right to participate in the Event in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to participate in an Event. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to participate.
- The Promoter reserves the right to disqualify participants in the event of non-compliance with these Conditions of Entry or where the Promoter has reason to believe that the participant has engaged in unlawful or other improper conduct calculated to jeopardize the fair and proper conduct of the Promotion. In the event that there is a dispute concerning the conduct of the Promotion or participation in an Event, the Promoter will resolve the dispute in direct consultation with the complainant/participant. If the dispute cannot be resolved the Promoter’s decision will be final.
- The Promoter, the Shopping Centre owner/s and their associated agencies, related companies, officers, employees and contractors will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or participating in any Event (or recommendation). For the sake of clarity, this clause shall not apply where the Promoter has contributed to or caused such loss, expense, damage, personal injury or death and shall not apply to any liability which cannot be excluded by law (in each case the Promoter’s liability is limited to the minimum allowable by law).
- The participant(s) will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter and Shopping Centre may use any such marketing and editorial material without further reference or compensation to them.
- Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
