About this Promotion:

This Promotion includes four levels:

  1. Instant Win Prize;
  2. Consumer Game;
  3. Venue Game; and
  4. Venue Staff Game;

Collectively referred to as the Promotion in these Conditions of Entry or separately where detailed.

Eligible entrants:

Consumer Game and Instant Win Prize: The Consumer Game and Instant Win Prize is only open to Australian residents who are 18 years and over. Employees (and their immediate family members) of the Participating Venues, agencies/companies directly associated with the conduct of this Promotion, the Promoter, its distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter the consumer component of the Promotion. "Immediate family member" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin

Venue Game: The Venue Game is only open to venues in Australia which agree to participate in this Promotion by displaying the consumer advertising for this Promotion in venue, will automatically be entered into the venue prize component of the Promotion (“Participating Venues”).

Venue Staff Game: The Venue Staff Game is only open to the staff employed (as at the time of the Venue Game) at the Participating Venue that is selected as the winner of the Venue Game. The owner and/or manager of the Participating Venue (as determined by the Promoter) will determine the employees of the venue which are eligible for the Venue Staff Game and any prizes in the Venue Staff Game (exact list of employees must be approved by the Promoter).

How to Enter:

To enter for the chance to win an Instant Win Prize or the chance to participate in the Consumer Game, the consumer entrant must complete the following steps during the Promotional Period:

  • purchase a jug of any Coca-Cola variety drink from any Participating Venue;
  • visit milliondollarjug.com.au, follow the prompts to the Promotion entry page; and fully complete and submit the online entry form into the Consumer Game with their personal details as requested, the unique code included on their scratch card and the details of the venue where they completed the jug purchase; and
  • scratch the game card to reveal if they have won an instant win prize. The entrant must scratch to reveal three (3) of the same nickname to win an instant win prize (free refill in venue). Details on how to redeem the prize are listed in the prizes section below.

Proof of Purchase: The game card will be perforated and the entrant must retain the section of the game card featuring the unique code used to enter online as proof of purchase. If the entrant fails to provide the game card/s for each entry submitted they will at the Promoter’s discretion be deemed invalid and forfeit any right to a prize.

Each Participating Venue will receive one (1) or more ‘kits’. Each kit contains 100 cards (includes 10 winning game cards). The total instant win prize pool per kit is $100. There will be a total minimum of 2,000 and maximum of 10,000 ‘kits’ distributed nationally. Some Participating Venues may be provided the opportunity to purchase more ‘kits’ out of their promotional support fund.

Entries permitted:

Multiple entries permitted into the Consumer Game, subject to the following:

  • limit one (1) entry and scratch card permitted per eligible transaction;
  • limit one (1) entry and scratch card permitted per person each day; and
  • each entry must be completed separate and in accordance with the entry instructions above.

Prize Description:

Instant Win Prizes (Scratch & Win Mechanic)

The instant win prize is a free jug re-fill of any Coca-Cola variety drink from the venue. The prize must be claimed at the same venue and during the same visit of receipt of the winning game card.

The winner must tear the game card across the perforated edge and provide the segment of the game card containing the scratch panel section to a staff member at the venue to redeem their prize; and retain the remaining section as proof of purchase.

Venue Staff Game Prize

A nominated staff member from the winning venue will receive the opportunity to play a game for the chance to win up to $50,000. Staff prize will be distributed amongst employees of the winning venue. The manger or owner of the winning venue (as determined by the Promoter) must provide the Promoter with a list of the reasonable split of the prize amongst employees (based on hours worked) and each employee’s bank details for prize award. The Promoter has full discretion in approving any split of the prize and may request further details from the Promoter regarding how they determined the split. Once the split is approved by the Promoter, the Promoter will award the cash amounts determined to each winning staff member via EFT, to a bank account in the winning staff member’s name.

Winner Determination & Game Details:

Consumer Game

  • The Consumer Game draw will take place at Plexus, Level 4, 411 Collins St, Melbourne VIC 3000, Australia at 12:00 pm AEDT on 01/03/21 using computerised random selection. All consumer entries will be included in the draw.
  • The first valid consumer entry drawn will receive the opportunity to play a game for the chance to win up to AUD$1,000,000 (“Consumer Game Winner”).
  • If a draw is scheduled on the weekend or a public holiday, the draw will be conducted at the same time and location on the following business day. The Promoter will ensure each draw is open for public scrutiny and anyone may witness the draw on request. The winner of a drawn prize is determined by chance.

Promotion Details

There will be three (3) consecutive games which take place at the Participating Venue where the winning consumer entrant completed the purchase associated with their winning entry (“Winning Venue”);

  • one (1) game for the Consumer Game Winner (“Consumer Game”);
  • one (1) game for the Winning Venue (“Venue Game”); and
  • one (1) game for the staff of the Winning Venue (“Venue Staff Game”).

All games will take place on the one (1) day on a date in March 2021 (with the exact date and time to be determined at a later date between the Promoter and manager or owner of the Winning Venue. In the event of a dispute as to the date/time of the games, the Promoter’s decision will be final). Due to any unforeseen reason or reason outside of the Promoter’s control (e.g. due to venue closure based on Covid-19, the Promoter may, in its full discretion, delay the games; or have the games take place via an online calling system (e.g. Zoom or Skype) or via phone.

  • Consumer Game

The Consumer Game Winner will be responsible for all costs associated with travel to and from the Winning Venue to play the Consumer Game.

There will be 40 envelopes on display at the start of the Consumer Game. Each envelope will contain a nickname (from the options in the below table). The Consumer Game Winner must select one (1) envelope at a time, without touching, handling or opening any other envelopes on display. Once an envelope is selected and opened, the Consumer Game Winner cannot place this back, and they will be required to reveal the nickname enclosed inside. Once the Consumer Game Winner has revealed five (5) of the same nickname they will win the respective prize outlined below for that corresponding nickname, subject to verification by the Promoter. Once five (5) of the same nicknames have been selected, the game will automatically conclude, and the Consumer Game Winner will not select any further envelopes.

Only one (1) of either the Ultimate Prize, Grand Prize, Major Prize or Minor Prize will be awarded based on the outcome of the Consumer Game. All three (3) remaining prizes will not be awarded.

If either the Ultimate Prize, Grand Prize or Major Prize is won via the Game in accordance with the rules above, the Loss Adjuster removes all envelopes and takes them back for validation of the prize claim before the respective prize is awarded. If the Ultimate, Grand Prize or Major Prize is not won via the Consumer Game in accordance with the rules above, the Loss Adjuster opens the Control envelope which reveals the numbers of each of the five (5) envelopes that contain the Ultimate winning message/s inside. The Loss Adjuster then opens the winning envelopes to show the guests that the AUD$1,000,000 was in there and that the mechanic is fair and secure.

N.B. A Loss Adjustor must be present at the ‘Game’/Event’ to ensure the Consumer Game is conducted as per these Conditions of Entry.

  • Venue Game

The Venue Game will be played by either the manager or owner of the Winning Venue (manager and owner must choose who between them plays and notify this to the Promoter in writing prior to the start of the game) (“Venue Player”). All costs associated with attending the game at the Winning Venue will be the Venue Player’s responsibility.

There will be 40 envelopes on display at the start of the Venue Game. Each envelope will contain a nickname (from the below options). The Venue Player must select one (1) envelope at a time, without touching, handling or opening any other envelopes on display. Once an envelope is selected and opened, the Venue Player cannot place this back, and they will be required to reveal the nickname enclosed inside. Once the Venue Player has revealed five (5) of the same nickname the Winning Venue will win the respective prize outlined below for that corresponding nickname, subject to verification by the Promoter. Once five (5) of the same nicknames have been selected, the game will automatically conclude, and the Venue Player will not select any further envelopes.

  • Venue Staff Game

The Venue Staff Game will be played by a current staff member of the Winning Venue (manager and owner must nominate a staff member to play and notify this to the Promoter in writing prior to the start of the game) (“Staff Player”). All costs associated with attending the game at the Winning Venue will be the Staff Player’s responsibility.

There will be 40 envelopes on display at the start of the Venue Staff Game. Each envelope will contain a nickname (from the below options). The Staff Player must select one (1) envelope at a time, without touching, handling or opening any other envelopes on display. Once an envelope is selected and opened, the Staff Player cannot place this back, and they will be required to reveal the nickname enclosed inside. Once the Staff Player has revealed five (5) of the same nickname the staff of the Winning Venue will collectively win the respective prize outlined below for that particular nickname, subject to verification by the Promoter. The division of prize amongst staff members of the Winning Venue is detailed in the prize section above. Once five (5) of the same nicknames have been selected, the game will automatically conclude, and the Staff Player will not select any further envelopes.

Only one (1) of either the Ultimate Prize, Grand Prize, Major Prize or Minor Prize will be awarded based on the outcome of the Game. All three (3) remaining prizes will not be awarded.

Further Details

Due to the timing of the game, if the Consumer Winner is not contactable within five (5) days of the original draw, they will automatically forfeit the prize and the Consumer Winner will be decided by the Unclaimed Prize Draw. Any venue specified in the respective winning entry (and their staff) will automatically forfeit any rights to the staff/venue prize (same applies for unsuccessful contact of an unclaimed prize draw consumer winner).

If for any reason the Promoter is unable to make contact with a Winning Venue prior to the games or organise for the game to take place at their venue, the Promoter may, in its full discretion, delay the games; or have the games take place via an online calling system (e.g. Zoom or Skype) or via phone. The respective venue will forfeit their right to the prize in such as case, and the Promoter will contact the venue specified in the next reserve consumer entry drawn to provide them with the opportunity to play the game for their venue and staff. This process will continue until a Participating Venue successfully claims the game opportunity. Each venue will be provided two (2) working days from first contact to claim the game play opportunity to allow for the game to take place in March 2021.

Winner notification:

The consumer winner will be contacted by email and phone within two (2) business days of the draw. The consumer winner will be published at milliondollarjug.com.au by 01/03/21. Once the consumer winner is confirmed and successfully contacted, the venue winner will then be notified via phone and email and published at milliondollarjug.com.au within two (2) business days.

Unclaimed Prizes:

The unclaimed prize draw will take place on 08/03/21 at 12:00 pm AEST at Plexus, Level 4, 411 Collins St, Melbourne VIC 3000, Australia. The consumer winner of the redraw will be notified by email and phone and published at milliondollarjug.com.au on the same day of the re-draw and must respond within two (2) business days of the redraw, confirming they can participate in the game. If they fail to do so they will be deemed invalid, and the next reserve entry will be contacted and provided one (1) day to confirm they will be able to participate in the game, the same process will continue with each subsequent reserve winner provided two (2) hours to claim before the Promoter deems them invalid.

General Terms:

  1. The entrant agrees and acknowledges that they have read these Conditions of Entry (and Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (and Schedule). Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless stated otherwise. Consumer, venue and venue staff entrants are all considered ‘entrants’ for the purposes of these general terms.
  2. The Promotion commences on the Start Date and ends on the End Date ("Promotional Period"). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
  3. Valid and eligible entries will be accepted during the Promotional Period.
  4. The probability of winning an instant win prize is 1 out of 10. Printing and other quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Instant win game materials void if stolen, forged, mutilated or tampered with in any way. The maximum number of promotional game cards that will be distributed during the Promotion is 1,000,000 .
  5. If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize by the time specified by the Promoter, or is unavailable, they forfeit the prize and the Promoter is not obliged to substitute the prize.
  6. Where entry is allowed by purchase or subscription, the cost of the product or service is no greater than the cost would be without the opportunity to participate in the Promotion.
  7. The value of the prize is accurate and based upon the recommended retail value of the prize (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prize after that date.
  8. No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter.
  9. If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and/or specification, subject to any written directions of a regulatory authority.
  10. No entry fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider.
  11. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
  12. Entrants' personal information will be collected by the Promoter. Personal information will be stored on the Promoter's database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at https://www.ccamatil.com/privacy-policy. The Promoter's privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter the Promotion. The Promoter may transfer entrants' personal information to countries specified in the Promoter’s privacy policy.
  13. For the purposes of public statements and advertisements, the Promoter may only publish the winner's surname, initial and State/Territory or postcode of residence.
  14. It is a condition of accepting the prize that the winner may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving the prize.
  15. If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Conditions of Entry, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Conditions of Entry or otherwise.
  16. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
  17. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
  18. The Promoter reserves the right, at any time, to validate and check the authenticity of entries and entrant's details (including an entrant's identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect and illegible entries, as applicable, will at the Promoter's discretion be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
  19. The Promoter reserves the right to disqualify entries in the event of non-compliance with these Conditions of Entry. In the event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
  20. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  21. The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.
  22. Unless otherwise specified, a prize is a single event for the winner (and where relevant their guests) and cannot be separated into separate events or components.
  23. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
  24. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
